Promotion Description
The new to cards promotion is an offer to allow eligible customers to use BOIPA’s services for a period of 5 months on a Ready Made or Tailor Made price plan. At the end of the first 5 months, you can return your BOIPA equipment in month 6 without incurring any early termination penalties. For each of the 5 months contractual fees apply. Offer only open to new BOIPA customers on a Ready Made or Tailor Made pricing plan who have not previously accepted card payments.
Eligibility
The promotion is only available to eligible merchants. You are only eligible to participate in this promotion if you meet the eligibility criteria set forth in the terms and conditions and accept the terms and conditions as outlined below. BOIPA reserves the right to verify the eligibility of all early termination requests and may, at its sole discretion, refuse to waive the early termination charges if the customer fails to satisfy eligibility requirements or gives false or misleading information.
Terms and Conditions
Defined terms
‘Eligible merchant’ means any business which has been actively trading for at least 6 months and who has not previously accepted card payments.
‘Participant’ or ‘you’ means you
‘Processor’ means BOI Payment Acceptance (BOIPA).
‘Ready Made’ is a pricing plan that, provided the merchant adheres to required parameters, offers a monthly flat fee pricing option.
‘Tailor Made’ is a pricing plan that allows for per-transaction charging (e.g. not a Ready Made flat monthly fee pricing).
General terms
The promotion is not available to participants who are ineligible for processor’s services.
The promotion is not available to existing customers of the processor or any of its affiliates.
The promotion structure is subject to modification or limitation at any time, with or without notice, at processor’s sole discretion, including, without limitation, the right to establish additional conditions for eligibility.
Participant agrees to be bound by these terms and conditions, and represents and warrants to processor that all information provided is accurate, up-to-date and complete.
Processor reserves the right to modify or terminate the promotion and these terms and conditions at any time without prior notice.
Processor reserves the right to totally or partially cancel or change the promotion, with or without prior notice.
Processor reserves the right to approve, deny or revoke participation in the promotion to any merchant for any reason whatsoever.
Processor will use reasonable efforts to ensure that sufficient prior warning is given should the promotion be cancelled, but will not be responsible for any losses or damages caused by its cancellation or modification.
Miscellaneous
These terms and conditions and the promotion will be interpreted, construed and enforced, and governed in all aspects in accordance with the exclusive jurisdiction and laws of the Republic of Ireland. Any claim, action, lawsuit, proceeding, or cause of action arising under or relating to these terms and conditions and/or the program will be brought exclusively in a court in the Republic of Ireland.
